Estos Términos regulan el uso de la aplicación móvil Comunidad del Laboratorio de Fitness (la «Aplicación»). Al descargarla, instalarla o utilizarla, aceptás quedar vinculado por ellos. Si no estás de acuerdo, no uses la Aplicación.
La Aplicación es operada por Verdell LLC, con domicilio en 16192 Coastal Hwy, Lewes, DE 19958-3608, Estados Unidos (en adelante, «nosotros»).
La Aplicación es un espacio privado de comunidad y acompañamiento para las personas participantes del programa. A través de ella podés acceder a materiales formativos, participar en los espacios de comunidad, comunicarte con el equipo y con otras personas participantes, y recibir avisos relacionados con tu proceso.
La Aplicación es una herramienta de acceso y comunicación. Su finalidad es informativa y formativa.
Al usar la Aplicación te comprometés a no:
Conservás la titularidad de todo el contenido que publiques. Al publicarlo, nos otorgás una licencia no exclusiva, gratuita y limitada para alojarlo, reproducirlo y mostrarlo dentro de la Aplicación, con el único fin de operarla. Esta licencia finaliza cuando eliminás el contenido o tu cuenta, salvo por copias residuales en respaldos técnicos.
Sos responsable del contenido que publicás. Podemos retirar sin aviso previo cualquier contenido que incumpla estos Términos.
Los materiales, textos, vídeos, imágenes, metodologías, marcas y el software de la Aplicación son titularidad de Verdell LLC o de sus licenciantes, y están protegidos por la normativa de propiedad intelectual e industrial.
Se te concede un derecho de uso personal, limitado, revocable, no exclusivo e intransferible sobre la Aplicación y sus materiales, exclusivamente para tu propio proceso. Queda prohibida su copia, distribución, comunicación pública, transformación o explotación comercial sin autorización expresa y por escrito.
El contenido de la Aplicación tiene finalidad informativa y formativa. No constituye asesoramiento médico, diagnóstico ni tratamiento, y no sustituye la consulta con un profesional de la salud matriculado.
Antes de iniciar o modificar un plan de ejercicio o de alimentación, consultá con tu médico, especialmente si tenés o sospechás tener alguna condición de salud, si estás embarazada o en período de lactancia, o si tomás medicación.
Participás bajo tu propia responsabilidad. Si durante la actividad física sentís dolor, mareo, dificultad respiratoria o cualquier síntoma inusual, detenete de inmediato y buscá atención médica.
Los resultados dependen de múltiples factores individuales y no pueden garantizarse.
Procuramos que la Aplicación esté disponible de forma continua, pero puede haber interrupciones por mantenimiento, actualizaciones, fallos técnicos o causas ajenas a nuestro control. La Aplicación se ofrece «tal cual» y «según disponibilidad», sin garantías de funcionamiento ininterrumpido o libre de errores.
Podemos modificar, añadir o discontinuar funciones de la Aplicación para mejorar el servicio.
Podemos suspender o cancelar tu acceso, con aviso previo cuando resulte razonablemente posible, si incumplís estos Términos, si tu conducta perjudica a otras personas participantes o a la comunidad, o si un requerimiento legal así lo exige.
Podés dejar de usar la Aplicación y eliminar tu cuenta en cualquier momento desde Perfil → Configuración → Eliminar cuenta, o escribiéndonos a coach@francosarli.com.
En la máxima medida permitida por la ley aplicable, no seremos responsables por daños indirectos, incidentales, consecuentes, pérdida de datos, lucro cesante ni por lesiones derivadas de la realización de actividad física sin la supervisión médica correspondiente.
Nada en estos Términos excluye o limita nuestra responsabilidad por dolo, culpa grave, o por aquello que la ley no permita excluir.
No respondemos por el contenido publicado por otras personas participantes ni por las opiniones que expresen en los espacios de comunidad.
La Aplicación puede integrarse con servicios de terceros necesarios para su funcionamiento (por ejemplo, los servicios de notificaciones de Apple y Google). Esos servicios se rigen por sus propias condiciones, sobre las que no tenemos control.
Podemos actualizar estos Términos. La versión vigente es siempre la publicada en esta página, con su fecha de actualización. Si el cambio es sustancial, te lo comunicaremos por correo electrónico o mediante un aviso dentro de la Aplicación. El uso continuado de la Aplicación tras la comunicación implica la aceptación de la nueva versión.
Estos Términos se rigen por las leyes del Estado de Delaware, Estados Unidos, con exclusión de sus normas sobre conflicto de leyes. Para cualquier controversia, las partes se someten a los tribunales competentes del Estado de Delaware.
Nada de lo anterior afecta los derechos imperativos que la normativa de protección al consumidor de tu país de residencia te reconozca, ni la posibilidad de acudir a los tribunales de dicho lugar cuando esa normativa así lo permita.

These Terms govern the use of the Comunidad del Laboratorio de Fitness mobile application (the "App"). By downloading, installing or using it, you agree to be bound by them. If you do not agree, do not use the App.
The App is operated by Verdell LLC, with registered address at 16192 Coastal Hwy, Lewes, DE 19958-3608, United States ("we", "us").
The App is a private community and support space for participants of the programme. Through it you can access learning materials, take part in the community spaces, communicate with the team and with other participants, and receive notices related to your process.
The App is an access and communication tool. Its purpose is informational and educational.
When using the App, you agree not to:
You retain ownership of all content you post. By posting it, you grant us a non-exclusive, royalty-free and limited licence to host, reproduce and display it within the App, for the sole purpose of operating it. This licence ends when you delete the content or your account, save for residual copies in technical backups.
You are responsible for the content you post. We may remove, without prior notice, any content that breaches these Terms.
The materials, texts, videos, images, methodologies, trade marks and software of the App are owned by Verdell LLC or its licensors and are protected by intellectual and industrial property law.
You are granted a personal, limited, revocable, non-exclusive and non-transferable right to use the App and its materials, exclusively for your own process. Copying, distribution, public communication, transformation or commercial exploitation without express written authorisation is prohibited.
The content of the App is informational and educational. It does not constitute medical advice, diagnosis or treatment, and is not a substitute for consultation with a licensed healthcare professional.
Before starting or modifying an exercise or nutrition plan, consult your doctor, especially if you have or suspect you have a health condition, if you are pregnant or breastfeeding, or if you are taking medication.
You participate at your own risk. If during physical activity you experience pain, dizziness, breathing difficulty or any unusual symptom, stop immediately and seek medical attention.
Results depend on multiple individual factors and cannot be guaranteed.
We aim to keep the App continuously available, but interruptions may occur due to maintenance, updates, technical failures or causes beyond our control. The App is provided "as is" and "as available", without warranty of uninterrupted or error-free operation.
We may modify, add or discontinue App features in order to improve the service.
We may suspend or terminate your access, with prior notice where reasonably possible, if you breach these Terms, if your conduct harms other participants or the community, or if a legal requirement so demands.
You may stop using the App and delete your account at any time from Profile → Settings → Delete account, or by writing to coach@francosarli.com.
To the fullest extent permitted by applicable law, we shall not be liable for indirect, incidental or consequential damages, loss of data, loss of profit, or injury arising from carrying out physical activity without appropriate medical supervision.
Nothing in these Terms excludes or limits our liability for wilful misconduct, gross negligence, or anything the law does not allow to be excluded.
We are not responsible for content posted by other participants or for the opinions they express in the community spaces.
The App may integrate with third-party services necessary for its operation (for example, Apple's and Google's notification services). Those services are governed by their own terms, over which we have no control.
We may update these Terms. The version in force is always the one published on this page, with its update date. If a change is substantial, we will notify you by email or through a notice within the App. Continued use of the App after such notice constitutes acceptance of the new version.
These Terms are governed by the laws of the State of Delaware, United States, excluding its conflict-of-law rules. For any dispute, the parties submit to the competent courts of the State of Delaware.
None of the above affects the mandatory rights granted to you by the consumer protection law of your country of residence, or the possibility of bringing proceedings before the courts of that place where such law so permits.
